RE: The tariff classification of 100% cotton batik printed woven fabric from Indonesia

Dear Mr. Glover:

In your letter dated February 9, 2012, on behalf of M M Fab Inc., you requested a tariff classification ruling.

The submitted sample is identified as “100% Cotton Fabric Printed in Batik Method Category 314-0”. According to the sample and the information provided, it is a plain woven cotton fabric, composed of 100% cotton and printed in batik. Your correspondence indicates that it contains 133 single yarns per inch in the warp and 72 single yarns per inch in the filling, with an average yarn number of 60. You indicate that the fabric weighs 133 g/m2 and will be imported in 115 centimeter widths.

The applicable subheading for “100% Cotton Fabric Printed in Batik Method Category 314-0” will be 5208.52.4020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of cotton, containing 85 percent or more by weight of cotton, weighing not more than 200 g/m2: printed: plain weave, weighing more than 100 g/m2: other: of numbers 43 to 68, poplin or broadcloth. The rate of duty will be 11.4% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
